Terms of Service

These Terms of Service govern your use of XPLR. Please read them carefully before using the service.

1. Acceptance And Eligibility

By accessing or using XPLR, you agree to these Terms of Service and our Privacy Policy.

You must be at least 15 years old to use XPLR. If you use XPLR on behalf of another person or organization, you confirm that you have authority to do so.

2. The Service

XPLR is a Serbia-first platform for discovering what is happening around you, primarily through event listings entered or managed for the service, with secondary community-event and social features.

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to access and use XPLR.

What XPLR is and is not

  • XPLR provides a platform and related tools.
  • Unless expressly stated otherwise, XPLR is not the organizer, venue, seller, promoter, or issuer for listed events.
  • Event information may come from users, third parties, or other sources and may change.

3. Accounts And Access

  • You need an account to use XPLR.
  • You must use a supported sign-in method.
  • You agree to provide accurate account and profile information and to keep it reasonably up to date.
  • You are responsible for activity that occurs through your account and for maintaining the security of your device and sign-in methods.
  • We may refuse, reclaim, or require changes to usernames that are misleading, unlawful, infringing, abusive, or impersonating another person or brand.

4. User Conduct

You agree not to use XPLR to:

  • break the law, violate the rights of others, or encourage harmful or fraudulent conduct;
  • post false, misleading, defamatory, hateful, violent, sexually exploitative, or spam content;
  • impersonate another person, venue, organizer, or brand;
  • harass, stalk, threaten, or abuse other users;
  • interfere with the service, APIs, or security controls;
  • scrape, reverse engineer, access without authorization, or otherwise misuse the service except as allowed by applicable law;
  • upload content you do not have the right to use or share.

If you use community-event features, you also agree not to:

  • present an unofficial event as if it were an official organizer, venue, or brand event;
  • create misleading or deceptive event listings, including false time, place, access, or participation details;
  • use event creation for scams, harassment, fraud, spam, or deceptive promotion;
  • repeatedly submit duplicate, low-quality, or misleading community-event entries.

You can report suspected abuse, illegal content, or infringement through the service where available or by contacting support@xplr.events. We may act based on user reports, internal review, fraud or safety concerns, or legal obligations, and may remove content, restrict access, or take other reasonable steps when needed to protect users or the service. Where appropriate, we may also consider follow-up or reconsideration requests.

We may remove, limit visibility of, or disable community-created events and suspend accounts that repeatedly abuse event creation, including without prior notice where safety, fraud, or service integrity reasonably requires it.

5. Your Content

You retain ownership of content you submit to XPLR.

By submitting content, you give us a non-exclusive, worldwide, royalty-free license to host, store, review, moderate, reproduce, adapt, format, display, and distribute that content as reasonably necessary to operate, provide, secure, and support XPLR across its app, web, and related surfaces.

This license ends when content is deleted from XPLR, except to the extent limited copies remain in backups, caches, logs, or as reasonably necessary for legal, security, abuse-prevention, or operational purposes. Our service providers may process content on our behalf where needed to operate XPLR.

You represent that you have the necessary rights to the content you submit and that it does not violate law or the rights of others.

6. Event And Listing Accuracy

Event information can change quickly. We do not guarantee that listings, schedules, locations, availability, prices, access conditions, or other event details will always be complete, current, or accurate.

  • You should verify important event details directly with the relevant organizer, venue, seller, or provider before relying on them.
  • If you submit event information or other content, you are responsible for making it accurate and lawful.
  • If you submit a community event or related details, you represent that you have the right to submit that information and that you will not present it as an official organizer, venue, or brand event unless you are authorized to do so.

7. Third-Party Services

XPLR may rely on third-party services, platforms, integrations, app stores, identity providers, messaging providers, map services, diagnostics providers, linked organizer or venue pages, and similar integrations. Your use of those third-party services may also be governed by their own terms and privacy policies.

We do not control third-party services and are not responsible for their content, policies, availability, or actions.

8. Intellectual Property

XPLR and its original app, site, software, branding, design, and related materials are protected by intellectual property laws. Except for the limited right to use the service under these Terms, no rights are transferred to you.

If you send feedback, ideas, or suggestions about XPLR, you agree that we may use them without restriction or compensation to you.

If you believe content in XPLR infringes your copyright, trademark, or other rights, you can contact support@xplr.events with enough detail for us to review the request.

9. Suspension And Termination

You can stop using XPLR at any time. You can also delete your account through the app.

If you cannot access the app, you can use our Delete Account page to request deletion outside the app.

We may suspend, restrict, or terminate access to XPLR if we reasonably believe you have violated these Terms, created legal or safety risk, abused the service, or interfered with operations.

10. Disclaimers And Liability

To the maximum extent permitted by law, XPLR is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted availability or that the service will always be error-free, secure, or fully accurate.

To the maximum extent permitted by law, XPLR and its operator will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, business, or opportunities arising from or related to your use of the service.

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including mandatory consumer protections.

You agree to indemnify and hold harmless XPLR and its operator from claims, losses, or expenses (including reasonable legal fees) arising from your violation of these Terms, your content, or your use of the service in a way that causes harm to others.

11. Governing Law And Disputes

These Terms are governed by the laws of Serbia.

If you are a consumer, this choice of law does not deprive you of mandatory protections that apply under the law of your country of habitual residence where such protections cannot be waived by contract.

Unless applicable law provides otherwise, disputes arising out of or relating to these Terms or the service will be submitted to the competent courts in Novi Sad, Serbia.

12. Changes To These Terms

We may update these Terms from time to time to reflect product changes, legal requirements, or operational updates. If we make a material change, we will update the "Last updated" date on this page and may provide additional notice through the app or website when appropriate.
